Washington, DC — Today, Meagan Hatcher-Mays, Director of Democracy Policy for Indivisible, issued the following statement:
“Last night, the conservatives on the Supreme Court issued an appalling decision that mandates the Biden administration to reinstate Donald Trump’s racist ‘Remain in Mexico’ policy, which requires migrants and asylum seekers to wait in deadly conditions in Mexico while trying to seek protection in the United States. This Court, glaringly partisan and no longer interested in maintaining a façade of objectivity, has put an untold number of immigrants at risk with this decision. And -- surprise -- there was no good legal reason to do it.
“Under Trump, the conservative justices took a broad view of executive power, granting Trump extensive discretion to implement whatever racist immigration policy he and cabinet of white supremacists had cooked up, no matter how flimsy the justification. Now that Joe Biden, a Democrat, is president, the Court is unsurprisingly having second thoughts on allowing the executive branch the authority to undo the damage.
“At this point, the current makeup of the Supreme Court is irredeemable. It is clear that political outcomes are more important to the conservative justices than upholding the Constitution or the law. Thanks to the unscrupulous tactics of Mitch McConnell and Donald Trump, the Supreme Court is now an institution so out of balance and so far outside the mainstream that we can no longer place our faith in it as a fair arbiter of justice. There is only one solution if we want to restore balance: we must add seats to the Court. If we do not, we can expect them to continue to do Trump’s dirty work for years to come.”
